Welcome to Duncan Trading Post! These Terms of Service ("Terms") explain the rules for using our website, duncantradingpost.com (the "Site"), and buying from our store. The Site is run by Duncan Trading Post LLC, a Florida limited liability company ("Duncan Trading Post," "we," "us," or "our"). We've tried to keep this in plain English.

1. Accepting these Terms

By visiting the Site or placing an order, you agree to these Terms and to our Shipping Policy, Refund Policy, and Privacy Policy, which are part of these Terms. If you don't agree, please don't use the Site.

2. Who can use the Site

You must be at least 18 years old, or the age of majority where you live, to place an order. If you're younger, you may use the Site only with the involvement of a parent or guardian. You agree to give us accurate, current information when you check out.

3. Our products and pricing

  • We sell MAKE FREIGHT SHAKE AGAIN and Freightliner Guy branded merch, including hats, hoodies, and flags. Every item is made to order and produced and shipped by our fulfillment partner.
  • We work hard to show colors and details accurately, but your screen may display colors a little differently than the real thing. Small variations in print or embroidery placement and size are normal for made-to-order products.
  • Prices are listed in US dollars and can change at any time without notice.
  • Mistakes happen. If there's an error in a price, description, image, or availability, we have the right to correct it, and to cancel or refuse any order affected by that error, even after the order is placed. If we cancel an order you already paid for, we'll refund you.
  • We may change or discontinue any product at any time.

4. Orders

Placing an order is an offer to buy. We may accept or refuse any order for any reason, including suspected fraud, unauthorized or reseller purchases, or product or pricing errors. We may also limit quantities. If we refuse or cancel an order after you've been charged, we'll refund your payment.

5. Payment

Payments are processed securely through Shopify Payments. By submitting payment, you confirm you're authorized to use the payment method and you allow us to charge it for the order total, including shipping and any applicable taxes. We don't store your full card details.

6. Shipping, returns, and cancellations

Shipping, returns, replacements, refunds, and cancellations are covered by our Shipping Policy and Refund Policy. In short: we currently ship to the United States only, every item is made to order, and we don't accept returns for wrong size, wrong color, or change of mind, but we'll make it right if your item arrives misprinted, defective, damaged, wrong, or is lost in transit. Please read those policies for the full details.

7. Intellectual property

Everything on the Site, including text, graphics, photos, logos, and designs, belongs to Drew Duncan and Duncan Trading Post LLC or is used with permission. MAKE FREIGHT SHAKE AGAIN and The Freightliner Guy, along with the related names, logos, and designs, are trademarks of Drew Duncan / Duncan Trading Post LLC.

Buying a product gives you the right to own and use that item. It doesn't give you any right to copy, reproduce, sell, or make your own merch using our names, logos, or designs. Please don't use them without our written permission.

8. Not affiliated with Freightliner or Daimler Truck

Duncan Trading Post is an independent business. We are not affiliated with, sponsored by, or endorsed by Freightliner, Daimler Truck, or any of their related companies. Any reference to Freightliner is used only to describe Drew's personal brand and work as a truck salesman. All other trademarks belong to their respective owners.

9. Reviews and other content you share

If you post a review, comment, photo, or other content on the Site or send it to us (your "Content"):

  • You confirm the Content is yours to share and is honest and accurate.
  • You agree not to post anything that's illegal, hateful, threatening, harassing, obscene, misleading, spam, or that violates someone else's rights.
  • You give us a free, non-exclusive, worldwide, ongoing permission to use, display, copy, and share your Content, including on the Site and our social media, in connection with our business. You still own your Content.
  • We may edit or remove any Content at any time, for any reason.

10. Using the Site

Please don't misuse the Site. That includes trying to hack it, disrupt it, scrape it, introduce viruses, or use it for anything illegal or fraudulent. We may suspend or block access for anyone who does.

11. Disclaimer

The Site and our products are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as stated in our Refund Policy. We don't promise the Site will always be available, error free, or free of viruses.

12. Limitation of liability

To the fullest extent allowed by law, Duncan Trading Post LLC, Drew Duncan, and our partners, suppliers, and service providers won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Site or any product. Our total liability for any claim related to an order will not be more than the amount you paid for that order. Some states don't allow certain limits on liability, so some of these limits may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Duncan Trading Post LLC, Drew Duncan, and our partners and service providers from any claims, losses, damages, and expenses (including reasonable attorneys' fees) that come from your breaking these Terms, your misuse of the Site, your Content, or your violation of any law or anyone else's rights.

14. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute related to these Terms, the Site, or your purchases will be handled in the state or federal courts located in Pinellas County, Florida, and you agree to the jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we'll post the new version on this page and update the "Last updated" date at the top. If you keep using the Site after changes are posted, that means you accept the updated Terms.

16. General

If any part of these Terms is found to be unenforceable, the rest stays in effect. Our not enforcing any part of these Terms doesn't mean we give up the right to enforce it later. These Terms, together with our policies, are the entire agreement between you and us about the Site.
